What happens next

The Examining Authority will make a decision about the date for the Preliminary Meeting(s) in due course.

In due course Interested Parties will receive an invitation to the Preliminary Meeting which is to discuss procedural matters only, and is held in public. It is not essential to attend the Preliminary Meeting. Whether or not an Interested Party chooses to attend the Preliminary Meeting, they will still be sent details of how to further take part in the Examination.

The Procedural Decision made after the Preliminary Meeting will be published on our website and will also be available on request from [email protected] and our helpline: 0303 444 5000. Importantly, this Procedural Decision will set the timetable for the Examination. The Examination Timetable will, amongst other things, set deadlines for receipt of detailed Written Representations and for comments on the Relevant Representations made by other Interested Parties.

If you are an Interested Party, either because you are one of the specific bodies cited in s102 of the Planning Act 2008 or have submitted a Relevant Representation, you will receive notifications about the Examination and a copy of the Secretary of State’s decision on the application once that is made.

If you have a legal interest in land affected by a Nationally Significant Infrastructure Project and:

  • have not been identified by the Applicant; and
  • did not register to become an Interested Party;

then you can make a request to the Examining Authority to become an Interested Party under s102A of the Planning Act 2008.

The additional period for making Relevant Representations has closed.

The Examining Authority (ExA) has published its Initial Assessment of Principal Issues (PDF, 139 KB). This is an initial high level assessment based on information available to the ExA at the time of writing and is not a comprehensive, exclusive, or detailed list. The ExA will have regard to all matters before it when it submits its Recommendation Report to the Secretary of State for Housing, Communities and Local Government after the Examination has concluded.

In its letter of 5th May (PDF, 957 KB) the ExA set out its decision that there will be a delay to the start of the Examination. The Applicant has now responded to the ExA’s letter (PDF, 419 KB).

The ExA will decide the start date for the Examination in due course. Updates will be provided on this site.

The Applicant has informed us that a number of notifications they sent about the opportunity to make Relevant Representations had not been received for various reasons. The Applicant has re-sent a further notification to those parties to allow them to make their representations. The Applicant has written to the Planning Inspectorate requesting additional time at the pre-examination stage to allow for on-going engagement in respect of the Site of Special Scientific Interest notification from Natural England.

The Examining Authority has issued a letter providing details of a Procedural Decision (PDF, 91 KB) taken in response to the Applicant’s letter of 15 April 2021.
