What happens next
A decision on the application for a Development Consent Order for Whitemoss Landfill Western Extension was taken on 21 May 2015 and has now been issued.
The period for legal challenge is defined in s118 of the Planning Act 2008. Further information about legal challenge can be found in the letter sent to all Interested Parties accompanying the Secretary of State’s decision and statement of reasons.

Examining Authority’s Recommendation Report
The Examining Authority completed its examination of this application at 11.59pm on 21 November 2014. The panel will now report to the Secretary of State for Communities and Local Government on or before 21 February 2015, who is expected to make a decision on or before 21 May 2015.
That decision and the panel’s report will be published on this website when a decision is made. The panel have asked us to thank all those who participated in the examination.
The Examining Authority has issued a draft DCO, a comparison of that DCO against the draft DCO submitted by the applicant on 30 October 2014, and a schedule of comments. Any comments from interested parties on the Examining Authority’s Draft DCO should be submitted by 17 November 2014.

The site visit due to take place on 15 July, and the hearings due to take place at the West Lancashire Investment Centre have been cancelled. (The open floor hearings due to take place at the Digmoor Community Centre, Birleywood, on 17 and 18 July have not been cancelled)
The Secretary of State has also decided to appoint two further Inspectors to the Examining Authority, which is now a panel of three. Philip Asquith and Robert Macey will join Wendy Burden in examining this application.

Procedural decision following Preliminary Meeting
At the Preliminary Meeting held on 21 May 2014, submissions were made about consultation carried out by the applicant, and the Examining Authority invited the applicant to respond to these submissions in writing. This written response was received Friday 23 May 2014 and has been published.
The Examining Authority has set a deadline for comments on the applicants submission by no later than 1200pm on Wednesday 28 May 2014 in advance of issuing the Rule 8 letter shortly after that.
