What happens next

A decision on the application for a development consent order for East Midlands Gateway Rail Freight Interchange was taken on 12 January 2016 and has now been issued.

The period for legal challenge is defined in s118 of the Planning Act 2008. Further information about legal challenge can be found in the letter sent to all interested parties accompanying the statement of reasons.

The Examining Authority (ExA) completed its examination of the application on 12 July 2015 and will now report on its findings. The ExA’s report and recommendation must be submitted to the Secretary of State for Transport on or before 12 October 2015. The Secretary of State will then have a further 3 months to make his decision on whether development consent should be granted.

The ExA has exercised its discretion and accepted an additional representation from Roxhill (Kegworth) Ltd comprising a schedule of proposed changes to the draft Development Consent Order (DCO) and draft Development Consent Obligation with North West Leicestershire District Council and Leicestershire County Council. This document will inform discussion at Item 2 of the agenda for the forthcoming issue specific hearing on matters relating to the draft DCO.

Additional representations have also been accepted by Nabarro LLP (for Lafarge Tarmac Trading Ltd) and Royal Mail.

The itinerary for the second site inspection in the company of interested parties (to be held on 11 June 2015) has also been published.
