There is a statutory duty, under section 51 of the Planning Act 2008, to record the advice that is given in relation to an application or a potential application, including the name of the person who requested the advice, and to make this publicly available.

Thank you for your phone call earlier enquiring as to why Sports England was not consulted by the Secretary of State on the applicant?s scoping report. I just wanted to follow up in writing and to let you know that I will upload a summary of our discussion onto our advice register on our website under section 51 of the Planning Act 2008 (as amended). I can confirm that, as discussed on the phone, the bodies consulted by the Secretary of State for scoping of a NSIP under the Planning Act 2008 are those prescribed in Schedule 1 of the Infrastructure Planning (Applicant?s: Prescribed Forms and Procedure) Regulations 2009. Sports England does not appear on this list and therefore were not consulted by the Secretary of State during the scoping process for the Hydrodec Oil Re-refinery project. With the exception of scoping, the pre-application process and consultation is undertaken entirely by the developer. We strongly encourage all applicant?s to consult widely during the pre-application stage and therefore welcome your intention to encourage the applicant to consult with Sports England. 23 October 2015 Warren Marshall of Peel Ports
