There is a statutory duty under section 51 of the Planning Act 2008 to record the advice that is given in relation to an application or a potential application and to make this publicly available. The Canal and River Trust is listed as a prescribed consultee for this project. This means that we have a statutory duty to consult you in accordance with Section 42 of the Planning Act 2008 (the 2008 Act) and Schedule 1 of The Infrastructure Planning (Applications: Prescribed Forms and Procedure) Regulations 2009 (as amended) (the APFP Regulations).
Now you have received the Rule 8 letter (detailing how the application is to be examined), you should only receive one further letter from us, the Section 99 letter which confirms the closing of the examination period. If there is a change to the timetable as set out in the Rule 8 letter, you will also receive this letter.
