Register of advice

The list below is a record of advice the Planning Inspectorate has provided in respect of the Planning Act 2008 process.

There is a statutory duty under section 51 of the Planning Act 2008 to record the advice that is given in relation to an application or a potential application and to make this publicly available. Advice we have provided is recorded below together with the name of the person or organisation who asked for the advice and the project it relates to. The privacy of any other personal information will be protected in accordance with our Information Charter which you should view before sending information to the Planning Inspectorate.

Note that after a project page has been created for a particular application, any advice provided that relates to it will also be published under the ‘s51 advice’ tab on the relevant project page.

Query regarding the Carbon Capture Readiness (CCR) and water resources in relation to the proposals for new gas powered generating stations.

Advice given

The applicants for NSIPs have to identify potential issues on how to deal with approaching Carbon Capture Storage (CCS), including availability of the additional land reserved for carbon capture. The applicants need to ensure that sufficient space is available on or near the site to accommodate carbon capture equipment in the future, as required by National Policy Statement for Energy (EN-1), section 4.7.
As the Examining Authority needs sufficient information to consider the issue against the NPS, the applicants are required to provide relevant documents supporting the application for a Development Consent Order (DCO) to authorise the project.
I would suggest that the best starting points are the recent decisions by the Secretary of State (SoS) who has granted development consent for the following applications:
1. South Hook Combined Heat & Power Station (23 October 2014) attachment 1, and
2. North Killingholme Power Project (11 September 2014) attachment 2.
